Kansas: Federal Judge Upholds ILLEGAL’s Right to Remain Silent on Status...The immigration agents went to a Kansas apartment looking for a man who had a drug conviction and whom they wanted to deport..the agents, without a warrant, also detained another man in the apartment they happened to come across and suspected of being in the country illegally. a federal judge said that the agent’s actions were unconstitutional and dismissed charges against José Manuel Ortiz-Del Rio. The judge’s ruling upheld the right of immigrants to remain silent under questioning from immigration authorities. U.S. District Judge Eric Melgren granted the government's motion to dismiss charges against Ortiz-Del Rio with prejudice, meaning the same charges cannot be filed again. Ortiz-Del Rio had been charged with falsely claiming U.S. citizenship.
